Types of Benefits Available To Injured Workers

Medical Benefits

Medical benefits refer to the type of treatment for any injuries caused by your workplace accident. In most cases, these medical treatments are required to be done by employer-provided doctors (known as panel physician).  Available medical benefits for a work-related injury can include surgery, physical therapy, medications and home medical equipment.  At our firm, we seek all available medical benefits to take care of your current and future medical needs.

Income Benefits

You are entitled to receive income benefits if an on-the-job injury keeps you out of work for more than seven days under Georgia law.  Income benefits fall into one of three categories.  Each category is listed below.   Factors determining which income benefits you are entitled include the severity of your injury, your ability to return to work and perform normal job duties, and the extent of your medical recovery.

Temporary Total Disability (TTD): If you are unable to work, you may receive a weekly check equivalent to two-thirds of your average weekly wage. You may receive TTD benefits for up to 400 weeks from the date of the accident.

Temporary Partial Disability (TPD): If you are able to return to work in a light duty capacity or you are forced to take a lower paying position because of your workplace injury, you are entitled to receive income benefits equal to two-thirds of the difference between your average weekly wage prior to the injury and the weekly wage you are able to earn after.  You may receive TPD benefits for up to 350 weeks after the accident.

Permanent Partial Disability (PPD): If your doctor has determined that you have reached “maximum medical improvement” and you are still partially impaired, you will receive an impairment rating based on the American Medical Association’s guidelines. If you are not getting TTD or TPD benefits, you are entitled to receive PPD benefits based on your impairment rating.
